  • Answer. Yes, temporarily, for the period from March 2022 and at the end of 12 months from the date of the lifting of martial law, Physical Entity Entrepreneur on a single tax may not pay Single Social Tax .

Question. PEE for more than one group collects reports for the 1st quarter, as in the previous quarter? I heard that the supplement for the SST will not need to be filled out.

  • Answer. For 1 sq. 2022 PEE 3 gr. submits a tax return of a single tax payer, in which he fills in the indicators for a single tax. Appendix 1 for SST is not completed.

Question. I worked at the clothing market, I was registered as an employee of an entrepreneur. There is such a situation that there is no work, but there are hostilities. And I decided to leave the country. If I find a job, how do I apply for a job?

  • Answer. If you are in another country, you can send your letter of resignation by mail, registered mail with acknowledgment of receipt. Under martial law, you can terminate your employment relationship at your own will without a two-week deferment due to hostilities in the region. Or you can send a photocopy to your employer's email address.

Question. The office is located in a region where hostilities are taking place. If an employee asked for unpaid leave, for what period can I issue such leave for him?

  • Answer. According to the legislation, during the period of martial law, the employer, at the request of the employee, can grant him unpaid leave without a time limit.

Question. The bartender of the cafe, which I own, was mobilized. That is, he is now unable to fulfill his direct professional duties. That's right, because now I can fire him?

  • Answer. No you can not. Moreover, the employer, according to the Labor Code, must retain the workplace and wages for such an employee. For non-compliance with these requirements, the employer will have to pay a fine in the amount of four minimum wages established at the time the violation was discovered.

Question. I am a self-employed person. Did not file the annual report on time and did not have time to pay income tax. But I heard that during martial law it is not punishable, right?

  • Answer. As for the deadlines for filing reports and paying taxes during martial law, this is true - now you are exempt from liability for non-compliance with the law. However, you will need to fulfill your obligations regarding filing reports and paying taxes within 6 months after the end of martial law in the country.

Question. I am an entrepreneur, on a single tax, the second group. May I know if I can avoid paying taxes now? Well, or voluntarily pay?

  • Answer. For now, you can pay voluntarily. But the situation can change at any moment. The government is just considering the issue of returning tax payments with standard terms.

Question. I am an employee of a private entrepreneur, I work in the market. We've always been good. I had two legal days off. And now he told me that the revenue has fallen, I will now have only one day off. Is it legal?

  • Answer. Most likely, your employer got acquainted with the March law "On the organization of labor relations under martial law", which said that under martial law, working time per week cannot exceed 60 hours (in peacetime - no more than 40 hours), and the duration weekly uninterrupted rest can be reduced to 24 hours.

Question. I wanted to clarify earlier, but that's all in the way. I'm talking about using software RST. If I am an entrepreneur, I trade in the market, the 1st single tax group, can I continue to work without it? Or do you need to hurry up with the purchase? Thanks in advance for your reply.

  • Answer. If you are PEE in the 1st single tax group, then you are exempt from the application of SRST.

Question. My employer has always been decent, I was very lucky with him. Now, when there is such a situation in the country, and we have no work, he told me that he would give financial assistance, 3,000 UAH. I am very grateful to him for this. But I still have taxes deducted from this amount? How much can I expect?

  • Answer. The amount of non-targeted charitable assistance from the employer, incl. material, in the amount not exceeding for the year 3470 UAH. (in 2022), not taxed.

Question. I want to register as an entrepreneur, sell beer at retail, I hope that soon it will be possible to do this freely. I was told that they would put me on the general tax system. But then the neighbor said that his relative used to do this, was on some kind of simplified system, of course, for me it would be better?

  • Answer. In this case, you will be on a simplified taxation system, on a single tax.

Question. I got a job as a salesman at the radio market. I brought my work to my employer, but he did not take it, he said that I should have it. Is it? At the previous job, the work was in the office, in a safe.

  • Answer. In connection with the changes regarding the work book, which came into effect last summer, now the work book is with the employee.

Question. I am an entrepreneur in the second group of the single tax. With the introduction of martial law, now I do not pay a single tax. How should I reflect this in the declaration? I hand over the report myself, so I want to clarify.

  • Answer. From April 1 of the current year until the end of martial law, if the PEE is on the 2nd group. does not pay a single tax, then this period in the declaration does not need to be filled out.

Question. I have one worker mobilized at the service station. But just now he would have to pay on sick leave. And he can't get it. How to be?

  • Answer. In this situation, he can instruct another person to receive the payment by making a power of attorney. According to the legislation, it is established that the power of attorney of a serviceman in the locations of the military unit, where there is no notary or body performing notarial acts, can be certified by the commander of this unit. Then send a photo of this power of attorney to you, that is, to your employer. Submit the original document later.

Question. Can I now count on a free vacation for more than a month?

  • Answer. Under martial law, an employer may grant an employee leave at his own expense for an indefinite period. But unilaterally, you cannot claim such leave. Only by agreement of the parties. If your employer believes that you should work now, then if you do not show up for work, he can put you on absenteeism, without a good reason, and even dismiss you for such absenteeism.

Question. I wrote a letter of resignation on my own and gave it to the entrepreneur, my employer. And today I met my former classmate, who now works in our employment center. She said that if I register as unemployed, then I will be entitled to benefits only after three months. How else would I have to state the reason for the dismissal?

  • Answer. In order for the payment of unemployment benefits to be accrued from the 8th day after registration at the employment center, the application must indicate "dismissal by agreement of the parties".

Question. My employee didn't show up to work. Doesn't answer phone calls. How to be?

  • Answer. According to the law, in the event of absenteeism of an employee, including absence from the workplace for more than three hours during a working day without a good reason, the employer receives a basis for his dismissal. However, if we are talking about the absence of an employee at the workplace due to hostilities in the region, then there are no grounds for dismissing the employee, but there are no grounds for maintaining the average salary for him.

Question. I am an entrepreneur, I used to pay 5% - income tax. I was advised to switch to a preferential option for now, now I will pay only 2%. But they said that every month I was given 20 days to file a report and 10 to pay the tax itself. Can you describe this process in more detail?

  • Answer. An entrepreneur in the 3rd group of a single tax at a preferential tax rate of 2% submits a declaration within 20 days from the end of the reporting period, and pays a single tax within 10 days after the deadline for filing a declaration. That is, the report is submitted before the 20th of the next month, and the tax is paid before the 30th.

Question. What should I do if my trademark certificate expires?

  • Answer. If the period of renewal of the trademark certificate falls on the period of the introduction of martial law in Ukraine, then the corresponding action to extend this certificate is considered to be performed by the person on time if it is performed no later than 90 days from the day following the day of termination or cancellation of martial law. From the day following the day of termination or cancellation of martial law, intellectual property rights may be extended in accordance with the established procedure.

Question. If during the hostilities I do not conduct economic activities, can I not pay for an excise license?

  • Answer. According to the information provided by the State Tax Service, there are licenses under which the next payment has not been paid before martial law is lifted or the license for the right has expired: • production and circulation of alcohol, alcoholic beverages, tobacco products and liquids used in electronic cigarettes; • production, storage, wholesale and retail trade in fuel and places of production, storage, wholesale and retail trade in fuel. The enterprise within 30 days after the lifting of martial law must pay regular payments and renew the license. Therefore, if you do not conduct business during the war, but have a valid license for the type of activity listed above, you must pay the appropriate fees.

Question. I work at a car market in Odessa. I am an entrepreneur on the 3rd group of the single tax. Do I need to file tax returns now? 18.08.2022

  • Answer. For sole proprietors of the 3rd group, it is already necessary to submit reports to the tax office. The grace period, the filing of financial statements after the established deadlines, has ended.

Question. I am an entrepreneur, registered in the Zaporozhye region, but currently I live in the Odessa region. I don’t have an accountant, I myself submitted reports to the tax office, paper ones. I have to submit a report in a month or so. Can you help me? 25.08.2022

  • Answer. If you do not have an electronic digital signature, then there are two options. The accountant of our company can file statements on your behalf, but for this you need to obtain such a signature. Or you can submit it yourself after receiving a digital signature.

Question. As an entrepreneur, I am an employer of several employees. At the moment, the scope of work has decreased, and I have to fire one of them, but this worker is in a different area. I want to send him an official notice by mail, but then how do I decide on the date of dismissal? 21.10.2022

  • Answer. An employment contract can be terminated at the initiative of the employer, including by sending an official notice by mail. In this case, the date of dismissal is considered to be the next business day after the date of delivery of such official notice to the employee by mail, but usually the sender receives the notice of delivery later. And what about the final settlement, the issuance of a copy of the order and a written notice of the amounts accrued and paid to the employee upon dismissal? Question. I heard information that when an unemployed person is employed, the state, as an employer, compensates for the costs of paying Single Social Tax to the tax office. How reliable is this information? 10/29/2022

  • Answer. The information is partially correct. The matter is that the bill is only approved in parliament, but the law is not accepted definitively yet. So, according to the bill, if you employ an unemployed person at the direction of the employment center, who was registered there at least 6 months ago, for a period of 2 years or more, then within 12 months from the state fund you will be compensated for the actual costs of paying for this employee of the single social tax that was accrued by your accountant and actually paid for such an employee.

Question. I have a hired worker - a designer at a distance. Is overtime paid for a non-fixed-time worker? 11/03/2022

  • Answer. In case of exceeding the statutory normal working hours (40 hours per week), payment is made at double the hourly rate for each hour of overtime work. If the work is performed outside the basic days and hours, but the total time of the employee's work does not exceed the normal working hours specified in the contract, such work must be paid in the amount specified in the employment contract.
